Amarillo Woman Pleads Guilty in Unprecedented Case

A 30-year-old Amarillo woman pleaded guilty Tuesday to delivering a controlled substance - crack cocaine - to her unborn son.

Tracy Ward's case has received allot of attention since the outcome of this case could determine the boundaries of the state law intended to protect the unborn. Ward's son tested positive for cocaine just after his birth last october.

Texas lawmakers passed a law last year that defines an embryo or fetus as an individual and allows criminal prosecution for preventable injury or death of a fetus. Ward's attorney says he plans to appeal the case, which he says is unconstitutional. The punishment phase of the trial is set to begin Wednesday morning.
