Only in Massachusetts, only our courts could do this with a straight face.
A man who is know in court papers as ?John Doe? filed a civil action against his ex-girlfriend. The man alleges that she was negligent when she suddenly changed positions while having sex and landed awkwardly on him injuring his penis. The man underwent emergency surgery, endured a painful and lengthy recovery and has suffered from sexual dysfunction that hasn?t responded to medication or counseling.

After loosing in Applet Court, the man?s attorney said the case will be appealed to the Supreme Judicial Court of Massachusetts. The Applet Court did acknowledge the woman may have exposed her boyfriend to some risk but determined her behavior wasn?t, ?Wanton or reckless?.

Ok, so I make a couple of phone calls and got the actual story. The two of them were having sex and generally enjoying themselves. Then the man decided it might be entertaining to enter another opening. The woman didn?t think that was a good idea and told the guy to just lay on his back and hold the member skyward. The heavy set woman stood over him and then dropped with all her weight on the man?s member. Successful entry was not achieved.

That would make me think she was mad at the man. He had done something that may well have caused her some discomfort and she decided to return the favor. Doesn?t that sound like reckless and or wanton?

Several years ago a woman was in her car and stopped at a stop light. An elderly couple were traveling behind her, didn?t notice she stopped and rear ended her. She filed suit saying that do to a back injury she suffered during the accident, she was no longer able to have an orgasm. The court awarded her $100,000+. It sounds like this guy can?t have an orgasm, it seems as if there is a court precedent.

Anyway, these are the reveting social issues our courts deal with.
